Non-molestation order solicitors in Leicester

Domestic abuse includes physical and sexual abuse, but also threats, coercive and controlling behaviour, and financial and emotional abuse. The family court can make orders to protect you and your children.

The two main orders

Non-molestation order. Stops the other person from using or threatening violence, harassing or intimidating you, or contacting you, and can stop them coming within a set distance of your home. It can protect children too. Breaking it is a crime.

Occupation order. Decides who can live in the family home, and can exclude the abuser from the home or the area around it, even if they own it or have a tenancy. The court weighs the balance of harm, so these orders are harder to get than non-molestation orders.

Both are applied for in the family court, which for Leicestershire sits in Leicester. You apply on form FL401 with a statement explaining what has happened.

Without notice applications

Where there’s a risk of significant harm, or the other person might try to stop you applying, the court can make an order without them being told first. A return hearing follows within a short period.

The police can issue Domestic Abuse Protection Notices and apply for orders. Leicester has specialist domestic abuse support services, and the National Domestic Abuse Helpline is available 24 hours.
