Personal injury claims seek compensation for injuries caused by someone else’s negligence, such as a road traffic accident, an accident at work, a fall on a poorly maintained pavement or in a shop, or poor medical treatment (clinical negligence).
This is a directory-only area. We list the firms so you can contact them directly, but we don’t pass on personal injury enquiries ourselves or take any payment connected with them.
Your solicitor gathers evidence of how the accident happened and who was responsible, obtains medical evidence about your injuries, and works out what you have lost, including earnings and costs of care as well as compensation for the injury itself. Most claims settle without going to court. Clinical negligence claims take longer and need expert evidence on whether the treatment fell below an acceptable standard.
Most personal injury claims are funded through conditional fee agreements, known as no win, no fee. If you win, some of your legal costs are recovered from the other side, and the solicitor may take a success fee from your compensation, capped at 25% of certain parts of it. Some firms also charge for insurance that protects you against paying the other side’s costs. Ask for a clear figure of what you would be likely to keep. Check too whether you already have legal expenses insurance through your car or home policy.
Look for a firm that regularly handles your kind of injury, and be cautious of anyone who contacted you unprompted after an accident. You don’t have to use the firm your insurer recommends.
Generally three years from the date of the accident or from when you first knew of the injury. Different rules apply to children and to people who lack mental capacity. Don't leave it late, as evidence is easier to gather early.
Under a conditional fee agreement you usually pay nothing if the claim fails. If it succeeds, the solicitor can take a success fee from your compensation, which for personal injury is capped at 25% of certain parts of the damages. Read the agreement carefully and ask what you'll actually receive.
Lower value whiplash claims from road traffic accidents can be made through the Official Injury Claim service without a solicitor. Higher value claims, and claims involving more serious injuries, are usually made with legal help.
