After an accident

Get medical help first. Then, if you can, collect the other driver’s details and insurer, photographs, witness contact details, and dashcam footage. Report the accident to the police if required, and tell your own insurer.

How claims work

Liability (who was at fault) is investigated, medical evidence is obtained, and losses are calculated: compensation for the injury itself plus financial losses such as earnings, care, travel and repairs. Most claims settle without a court hearing.

The whiplash reforms

For road traffic accidents since 31 May 2021, lower value injury claims by vehicle occupants, especially whiplash, go through the Official Injury Claim portal, with fixed compensation tariffs for whiplash and a higher small claims limit. For claims above the limit, or involving more serious injuries, solicitors usually act on a no win, no fee basis.

Time limits

Usually three years from the accident, or from when you realised you’d been injured. Different rules apply to children and people who lack capacity.

No win, no fee

Under a conditional fee agreement, if the claim succeeds the solicitor’s success fee comes out of your compensation, capped at 25% of certain parts of it. Ask for a clear estimate of what you’ll receive. You don’t have to use the firm your insurer suggests.
